Providers forced to purchase gas only through the stock exchange

The Romanian Government adopted, in late September, an emergency ordinance governing the obligation of suppliers to purchase gas delivered to domestic customers “on the basis of procedures in order to ensure the transparency of the procurement process for gas."

The normative act maintains the current system of allocating the quantities of natural gas to household customers and to electricity producers, but only for the amounts of natural gas needed to produce thermal energy for household consumption by March 31, 2017. "For the period December 1, 2016 - December 31, 2017 it regulates the obligation for producers and the obligation of every gas supplier, who is not also a manufacturer, to conclude contracts on centralized markets in Romania, transparent and non-discriminatory, in accordance with regulations issued by ANRE," according to a press release, quoted by Ziarul Financiar.
Moreover, for the period January 1, 2018 – December 31, 2021, there are obligations regulated for manufacturers and suppliers, who do not have the quality of the manufacturer, to conclude contracts on the centralized markets of Romania, transparently and non-discriminatorily.
The Romanian Government also states that by maintaining the solution for delivery of natural gas to domestic customers, "based on final prices regulated by ANRE until June 30, 2021, in accordance with law, it shall ensure conditions control of ANRE on the final price for the marketing of natural gas by suppliers to domestic customers."
The expected changes have the objective to ensure necessary prerequisites closure of the infringement procedure and eliminating the imminent risk of sending this question to the European Court of Justice and consequently eliminating the risk of imposing fines charged to the Romanian state.
