CONAF supports the right of option in listing private companies
In this post-pandemic period, extremely complicated and tense, in the conditions of a war on the Romanian border and overlapping crises, we argue that Parliament must find solutions to support the business environment through a non-bureaucratic, fair, and sustainable climate.
The National Confederation for Female Entrepreneurship (CONAF) considers the legislative initiative no. B254 / 2022 (which could force companies and PFAs to pay a fee to the Romanian Chamber of Commerce and Industry) bureaucratic, excessive, and inappropriate. The listing of a company, in any type of catalog, must be optional and bring marketing benefits to the company.
“The proposal, which is a resumption of a rejected initiative, is bureaucratic and redundant because it imposes a new obligation, this time this year. All companies are already present in the Trade Register and to register annually, for a fee in a catalog of companies managed by a private entity, (such as the Chamber of Commerce and Industries – CCIR) must be an option of every entrepreneur.
If CCIR wants to have all the information about Romanian companies, it can do so by taking data from the Trade Register without imposing additional taxes and costs. In our opinion, CCIR was created as a support structure, modern, efficient, and useful for the business environment, which aims to attract and not tax for private companies, much less for authorized individuals. The presence of a company in a catalog, be it national, must be optional and seen as a promotional tool, not mandatory and for a fee.
The business activity is extremely diverse, and its regularity belongs exclusively to its owner. The decision to suspend an activity depends on each one. And the imposition of taxes and fines on inactive companies contradicts the freedom to make entrepreneurial decisions.
I believe that any instrument, structure, or legislative decision must support debureaucratization and in general finding viable solutions for the business environment,” said Cristina Chiriac, President of CONAF.
“On the other hand, we do not consider it appropriate to oblige an entrepreneur or an authorized natural person to obtain, through CCIR or any other entity with an imposed monopoly, the certificate of competence introduced by the same legislative proposal. It is a bureaucratic approach, useless for entrepreneurs already qualified through studies or certificates obtained, with an as yet undefined path, in a business environment that has long been under European standards.
We understand the argument for creating a professional entrepreneurship, but any entrepreneur, be he a graduate of Harvard University or Valea Mare High School, has the right to open a business on his own money, if he considers himself competent in the chosen field and respects the rules of production and safety. of the consumer.
We do not consider that, in a living structure such as the business environment, an entrepreneur must obtain a certificate of competency from an institution that imposes occupational standards without thorough public consultation. The educational process for certain categories of workers is decentralized and the imposition of qualifications for managers is unprecedented, I believe in the world.
The Harvard graduate’s certificate of competency is his or her own diploma, but if he or she wants to do business in the United States, no one will issue a certificate that he or she is competent. Consequently, the National Confederation for Female Entrepreneurship (CONAF) considers legislative initiative no. B254 / 2022, in contradiction with any positive strategy for the Romanian business environment and discourages entrepreneurial initiative.
